Terms of Service

These Terms and Conditions ("Terms") govern your use of Thought Digest Media Group’s website, mobile application, membership services, equipment hire services, and any other services provided by Thought Digest Media Group (collectively referred to as the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.

1. Acceptance of Terms

By accessing or using the Service, you acknowledge that you have read, understood, and agree to be bound by these Terms and our Privacy Policy. If you do not agree to any provision of these Terms or our Privacy Policy, please do not access or use the Service.

2. Intellectual Property Rights

The Service and its original content, features, and functionality are owned by Thought Digest Media Group and are protected by international copyright, trademark, patent, trade secret, and other intellectual property or proprietary rights laws.

You may not reproduce, modify, distribute, display, perform, or otherwise use any content from the Service without prior written consent.

3. User Content

You may have the opportunity to submit, post, or share content, such as comments, reviews, or other materials, on or through the Service ("User Content").
By submitting User Content, you grant us a non-exclusive, royalty-free, perpetual, irrevocable, and fully sublicensable right to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, and display such User Content throughout the world in any media.

You are solely responsible for any User Content you submit and agree not to submit content that is unlawful, defamatory, libelous, threatening, harassing, abusive, obscene, or otherwise objectionable.

4. Third-Party Links

The Service may contain links to third-party websites or resources not owned or controlled by Thought Digest Media Group. We assume no responsibility for the content, privacy policies, or practices of any third-party websites or resources.

You acknowledge that Thought Digest Media Group is not liable for any damage or loss caused by or in connection with the use of such content, goods, or services.

5. Disclaimer of Warranties

The Service is provided "as is" and "as available," without any warranties of any kind, express or implied.
We do not guarantee that the Service will be uninterrupted, secure, or error-free, nor do we guarantee the accuracy, reliability, completeness, or timeliness of any content.

6. Membership Terms

a) Membership Tiers

Thought Digest Media Group ("TDMG") offers optional membership programs ("Press Club") with various benefits depending on the tier selected (e.g., Bronze, Silver, Gold, Diamond).

b) Voting Rights and Community Input

Certain membership tiers (Silver, Gold, Diamond) may offer members the opportunity to participate in surveys, polls, and voting processes regarding TDMG’s content direction, topics, initiatives, or projects.

Important Note:
These voting opportunities are not legally binding, enforceable, or contractual in any way.
They are provided purely as a tool for community engagement, audience research, and marketing purposes.

TDMG greatly values member input and, more often than not, will align with community suggestions. However, participation does not confer any ownership, management rights, control, or binding influence over Thought Digest Media Group or its activities.

7. Equipment Hire Terms

a) Eligibility

Equipment Hire is available to eligible users subject to acceptance of additional Equipment Hire Agreements and verification requirements (such as photo ID and security deposit).

b) Hire Period and Availability

All hire periods must be booked in advance through our official booking system. Equipment availability is on a first-come, first-served basis.

c) Damage, Loss, or Theft

Hirers are responsible for the full replacement cost of equipment that is lost, stolen, or damaged during the hire period, regardless of fault.

d) Late Returns

Late returns without prior notice will incur additional fees based on daily hire rates.

e) Cancellation Policy

Cancellations must be made at least 24 hours prior to the scheduled hire time to avoid penalty fees.

f) Binding Contract and Payment Obligation

By submitting an equipment rental order through our Service, you enter into a legally binding rental agreement with Thought Digest Media Group.

You agree to pay the invoiced amount in full within 24 hours of placing your order unless otherwise agreed in writing.

Failure to pay within 24 hours will result in the following actions:

Cancellation of your order;
Forfeiture of any reserved equipment;
A permanent ban from making future hires, purchases, or bookings with Thought Digest Media Group.

7.1 Equipment Rental Agreement

Payment Terms:
Payment must be made prior to pickup or delivery via approved methods (Direct Bank Transfer / PayID).

Condition and Use of Equipment:
Equipment must be used only for its intended purposes and returned in the same condition (ordinary wear and tear excepted).

Damage, Loss, or Theft:
The lessee is fully responsible for the Equipment while in their possession and must reimburse the full replacement or repair cost if any damage, loss, or theft occurs.

Late Return Policy:
Late returns are subject to additional fees.
Failure to return Equipment within [7] days after the due date without communication may result in legal action.

Bond Refund:
Applicable security bonds will be refunded within [3–5] business days after equipment inspection.

Insurance:
Lessee must arrange their own insurance if desired. TDMG is not liable for damages, injuries, or losses during the hire.

Indemnification:
The lessee agrees to indemnify and hold harmless TDMG from all claims arising from the use or misuse of the equipment.

8. Public Liability Insurance

TDMG maintains a public liability insurance policy covering certain public events, productions, and activities conducted by Thought Digest Media Group.

However, please note:

Equipment hire users are not covered by TDMG’s insurance — they must have or arrange their own insurance if required.
Participation in public activities may involve inherent risks. Users, hirers, and participants assume all risks and responsibilities associated with their involvement unless otherwise stated in writing.

9. Governing Law

These Terms shall be governed by and construed in accordance with the laws of the Commonwealth of Australia and the State of Tasmania, without regard to conflict of law principles.

10. Changes to Terms

Thought Digest Media Group reserves the right, at its sole discretion, to modify or replace these Terms at any time.
If a revision is material, we are not obligated to notify users before changes take effect but will provide notice after the changes are implemented.
